By accessing or using the KIGALINOW platform ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use our Platform. These Terms constitute a legally binding agreement between you and KIGALINOW.
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the modified Terms.
To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to comply with these requirements.
Subject to your compliance with these Terms, KIGALINOW grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform for your personal, non-commercial educational purposes.
You agree not to: (a) license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Platform; (b) modify, make derivative works of, disassemble, reverse compile, or reverse engineer any part of the Platform; (c) access the Platform in order to build a similar or competitive service; (d) use the Platform in any unlawful manner or in violation of these Terms.
All educational content, including videos, text, graphics, logos, and software, is the property of KIGALINOW or its content suppliers and protected by copyright and other intellectual property laws. The compilation of all content on this Platform is the exclusive property of KIGALINOW.
You may access content for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content without express written permission from KIGALINOW or the respective copyright owner.
You agree not to use the Platform to: (a) harass, abuse, or harm another person; (b) submit false or misleading information; (c) upload or transmit viruses or any other type of malicious code; (d) collect or track the personal information of others; (e) spam, phish, or engage in unethical marketing practices; (f) interfere with or disrupt the Platform or servers; (g) attempt to gain unauthorized access to any portion of the Platform.
Violation of these conduct guidelines may result in termination of your account and access to the Platform.
Certain features of the Platform may require payment of fees. You agree to pay all applicable fees as described on the Platform. All fees are non-refundable except as required by law or as otherwise stated on the Platform.
KIGALINOW reserves the right to change its pricing at any time. If KIGALINOW changes its fees, KIGALINOW will provide notice of the change on the Platform or in email to you. Your continued use of the Platform after the price change becomes effective constitutes your agreement to pay the changed amount.
We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. KIGALINOW makes no representations or warranties of any kind, express or implied, as to the operation of the Platform or the information, content, or materials included thereon.
To the full extent permissible by law, KIGALINOW disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. KIGALINOW does not warrant that the Platform will be uninterrupted, timely, secure, or error-free.
In no event shall KIGALINOW, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Platform; (b) any conduct or content of any third party on the Platform; (c) any content obtained from the Platform; (d) unauthorized access, use, or alteration of your transmissions or content.
In no event shall KIGALINOW's total liability to you for all damages exceed the amount of fifty dollars (USD $50.00). The limitations of liability set forth in this section will survive any termination or expiration of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Rwanda, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Kigali, Rwanda for any legal actions arising from these Terms or your use of the Platform.
